1. Acceptance of Terms

Terms of Service

Terms governing your use of the Growthsim platform.

Effective: March 2026

GrowthSim (“we”, “us”, “our”) is operated by Growthsim OÜ, a private limited company registered in the Republic of Estonia. These Terms of Service (“Terms”) govern your access to and use of the GrowthSim platform, including our website, dashboard, simulation engine, AI copilot, and all related services (collectively, the “Service”).

Please read these Terms carefully before using the Service. By creating an account or using any part of the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using GrowthSim, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you may not use the Service.

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

If you are using the Service on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In such cases, “you” refers to both you individually and the entity you represent.

Your continued use of the Service following any posted changes to these Terms constitutes acceptance of those changes.

2. Definitions

The following terms have specific meanings throughout these Terms:

TermDefinition
ServiceThe GrowthSim platform, including the website, dashboard, simulation engine, AI copilot, APIs, and all related features and tools.
OrganizationA workspace created on GrowthSim representing a company or team. All data, simulations, and billing are scoped to the Organization.
Your DataAll data you provide to the Service, including questionnaire responses, business information, team composition, and financial inputs.
Simulation OutputsResults generated by the simulation engine based on Your Data, including risk scores, charts, metrics, Monte Carlo statistics, events, and sensitivity analysis.
AI OutputsAnalysis, insights, recommendations, and responses generated by the AI copilot based on Your Data and Simulation Outputs.
TokensThe unit of consumption used to meter simulation runs and AI copilot usage within the Service.
SeatsAdditional team member slots purchased for an Organization beyond those included in the subscription plan.
On-Demand UsageToken consumption beyond the monthly allocation included in your plan, billed at premium rates via Stripe metering.

3. Account Registration & Security

To use GrowthSim, you must register an account with a valid email address and maintain accurate, up-to-date account information. Each user may be associated with one Organization at a time.

Your Responsibilities

You are responsible for:

  • Safeguarding your login credentials and not sharing them with others
  • All activity that occurs under your account, whether or not authorized by you
  • Notifying us immediately at [email protected] if you suspect unauthorized access to your account
  • Keeping your account information accurate and current

Account Suspension

GrowthSim reserves the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, fail to pay applicable fees, or remain inactive for extended periods (12 months or more). We will make reasonable efforts to notify you before suspending your account, except where immediate action is required to protect the Service or other users.

4. Organizations & Team Access

4.1 Organization Accounts

The Service is provided to Organizations, not to individual users. The person who creates an Organization is the initial Owner. Organizations may have multiple members (“Seats”) subject to plan limits.

4.2 Administrator Responsibilities

Organization Owners are responsible for:

  • Managing team member access and permissions
  • Ensuring all team members comply with these Terms
  • Controlling which team members can initiate simulations and thereby consume Tokens
  • Promptly removing access for departing team members
  • All activity occurring under the Organization account
  • All billing and payment obligations for the Organization

4.3 Seats

Each subscription plan includes a base number of Seats. Additional Seats may be purchased at the published per-seat rate. All team members within an Organization share the same Token pool and AI budget. Organizations may have a maximum of 11 members (1 Owner plus up to 10 additional Seats, depending on plan).

Seat billing is pro-rated: adding Seats mid-cycle incurs a pro-rated charge for the remainder of the billing period. Reducing Seats takes effect at the end of the current billing cycle.

4.4 Data Ownership Within Organizations

All data entered into, generated by, or stored within an Organization account (including questionnaire responses, simulation results, and AI chat history) is owned by the Organization, not by individual team members. When a team member is removed from an Organization, their contributed data remains with the Organization.

4.5 Invitations

Team invitations are valid for 7 days from the date of issue. The Organization Owner is responsible for ensuring that invitations are sent only to authorized individuals. Expired invitations must be re-issued.

5. Subscription & Billing

5.1 Plans

GrowthSim offers tiered subscription plans (Free, Pro, Max, and Mad Max) with Token-based metering. Current plan details, pricing, Token allocations, and feature availability are published on our pricing page and within the dashboard. All prices are in euros (EUR) and exclude applicable taxes.

Annual billing is available for all paid plans. Annual subscriptions are billed upfront for 12 months at the published annual rate.

5.2 Token System

Everything in GrowthSim is metered in Tokens. Quick Runs and Deep Analysis runs each consume Tokens at the rates published in the dashboard. The AI copilot also consumes Tokens from the same shared pool. Higher-capability AI modes consume more Tokens per question than the default mode. Current Token consumption rates are displayed before you initiate any simulation or AI interaction.

5.3 Token Expiration

Tokens included with your subscription plan expire at the end of each billing cycle and do not roll over to the next period. Unused Tokens carry no cash value and are non-transferable between Organizations.

5.4 On-Demand Usage

On-Demand Usage is available on eligible plans only. When your monthly Token allocation is exhausted, you may continue using the Service at the premium per-Token rate published on your plan’s pricing page, billed via Stripe metering at the end of each billing cycle.

You control On-Demand Usage through your account settings with three modes: Unlimited (no cap), Fixed (you set a monthly spend cap in euros), or Disabled (simulations stop when Tokens run out). On-Demand Usage is automatically disabled if a payment fails.

5.5 AI Budget

Each paid plan includes a separate EUR-denominated AI budget that covers the cost of AI copilot usage. This budget is calculated as a percentage of your subscription fee and scales with additional Seats. A hard safety cap ensures that our cost to operate the AI copilot for your Organization never exceeds a fixed percentage of your subscription revenue.

If you approach your AI budget limit, the system will automatically restrict you to the most cost-efficient AI mode (Fast) to preserve remaining budget.

5.6 Free Trial

First-time paid subscribers are eligible for a 14-day free trial. During the trial, you have full access to the features of your selected plan. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable fee. Free trials are not available to returning customers who have previously held a paid subscription.

5.7 Payment Processing

All payments are processed by Stripe. We never see, store, or have access to your full payment card details. By subscribing to a paid plan, you authorize Stripe to charge your payment method on a recurring basis at the applicable rate. All amounts are billed in euros (EUR).

5.8 Failed Payments

If a payment fails, your subscription enters a “past due” status. On-Demand Usage (both simulation and AI) is immediately disabled. Stripe will automatically retry the payment according to its retry schedule. If payment cannot be collected, your subscription may be canceled and your plan downgraded to Free.

5.9 Plan Changes

When switching plans, your Token allocation is recalculated for the new plan. If you downgrade to a plan that does not support On-Demand Usage, it will be automatically disabled.

5.10 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • Your subscription remains active until the end of the current billing period
  • On-Demand Usage is immediately disabled
  • At the end of the billing period, your plan is downgraded to Free and remaining billing credits are expired
  • No pro-rata refunds are provided for the unused portion of your billing period

5.11 Refunds

Token purchases and subscription fees are generally non-refundable. If a simulation fails due to a platform error (not due to invalid user input), the consumed Tokens will be automatically refunded to your Organization’s Token balance.

5.12 Metering

GrowthSim’s internal metering systems are the sole authoritative measure of Token consumption and AI usage. You may review your usage at any time through the dashboard. If you believe there is a metering error, you must notify us within 14 days of the relevant billing cycle. We will investigate and, if an error is confirmed, correct your Token balance or issue a credit.

5.13 Price Changes

We may modify our pricing, Token consumption rates, or plan structures at any time. Material pricing changes will be communicated via email at least 30 days before taking effect. Your continued use of the Service after the new pricing takes effect constitutes acceptance of the updated pricing. If you do not agree with a price change, you may cancel your subscription before the change takes effect.

6. Service Description

GrowthSim is a financial stress-testing platform designed for digital agencies and project-based businesses. The Service processes business data you provide (including team composition, pricing models, capacity metrics, payment terms, and financial parameters) to generate probabilistic forecasts, risk scores, and AI-driven recommendations.

How It Works

  • Questionnaire: You fill out a guided questionnaire with company-specific data covering customers, team, delivery, costs, hiring, and payment terms.
  • Simulation: Our engine runs Monte Carlo simulations over your data, modeling thousands of possible futures under stochastic conditions.
  • Results: You receive risk scores, daily metric projections with confidence bands, event probabilities, sensitivity analysis, and actionable insights.
  • AI Copilot: A specialized AI assistant (powered by large language models) that can analyze your simulation results, answer questions about your data, and provide recommendations grounded in your specific simulation output.
Simulation results and AI recommendations are intended as decision-support tools, not financial advice, predictions, or guarantees of future performance. See Section 8 for important disclaimers.

7. Acceptable Use

You agree to use GrowthSim solely for lawful business analysis purposes and in accordance with these Terms.

Prohibited Conduct

You may not:

  • Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the simulation engine, AI models, or any other proprietary component of the Service
  • Abuse, circumvent, or deliberately exceed the rate limits imposed by the Service
  • Submit intentionally misleading, fraudulent, or fabricated questionnaire data to manipulate simulation outputs
  • Access the Service through automated means (bots, scrapers, crawlers) except through officially provided APIs
  • Attempt to access data belonging to other Organizations or users
  • Use Simulation Outputs or AI Outputs to intentionally mislead third parties about financial projections or business performance
  • Resell, redistribute, or commercially sublicense Simulation Outputs or AI Outputs without our prior written authorization
  • Use the Service to violate any applicable law, regulation, or third-party rights
  • Interfere with or disrupt the integrity, security, or performance of the Service

Rate Limits

The Service imposes per-user and per-Organization rate limits to ensure fair usage and platform stability. These limits apply across all endpoints and may vary by plan. Deliberately attempting to circumvent rate limits may result in temporary or permanent suspension of your account.

API & White-Label Access

Programmatic API access and white-label licensing are available under separate commercial agreements. Contact us at [email protected] for details.

8. AI & Simulation Disclaimers

This section is critical. GrowthSim uses stochastic simulation models and AI language models to generate analysis and recommendations. These outputs are probabilistic estimates, not predictions, guarantees, or professional advice. Please read this section carefully.

8.1 Not Financial Advice

The Service, including all Simulation Outputs, AI Outputs, risk scores, recommendations, and insights, is provided for informational and decision-support purposes only. Nothing in the Service constitutes:

  • Financial, investment, tax, legal, or accounting advice
  • A recommendation or solicitation to take any specific business action
  • A guarantee or prediction of future financial performance
  • A substitute for consultation with qualified professional advisors

You acknowledge that business decisions involve risks that cannot be fully captured by any simulation model, and you assume full responsibility for any decisions made based on information provided by the Service.

8.2 Simulation Model Characteristics

Our simulation engine uses advanced Monte Carlo methods, copula-based correlation modelling, and adaptive convergence to produce statistically robust scenario analysis. While the engine is built on a strong mathematical foundation, all simulation models operate within inherent boundaries:

  • Simulations model a comprehensive but finite set of operational and financial variables. They do not account for extraordinary events, regulatory changes, or other unforeseeable external factors
  • Correlation structures between variables are modelled using established statistical techniques, but represent approximations of real-world dependencies
  • Simulation results are most valuable for horizons up to 1 year; longer horizons carry greater uncertainty as assumptions compound over time
  • The quality of Simulation Outputs depends on the accuracy and completeness of the data you provide. Better inputs produce more reliable results
  • Quantitative outputs (scores, percentages, confidence intervals) represent probabilistic estimates, not deterministic predictions

8.3 AI-Generated Content

The AI copilot uses large language models (provided by Anthropic) to generate analysis and recommendations based on your simulation data. You acknowledge and agree that:

  • AI-generated outputs may contain inaccuracies, errors, inconsistencies, or omissions
  • AI models may produce different outputs for identical inputs across different sessions
  • AI-generated content is based on your simulation data and language model capabilities and should be validated against your own business knowledge
  • We make no representation or warranty regarding the accuracy, reliability, or completeness of AI-generated content

Your data is processed by the AI copilot on a per-request basis only. Anthropic does not retain your data beyond request processing and does not use your data to train their models. For details, see our Privacy Policy, Section 4.

8.4 Your Responsibility

You agree that you will:

  • Review all Simulation Outputs and AI Outputs before making any business decision
  • Apply your own professional judgment and, where appropriate, consult qualified financial, legal, or business advisors
  • Not treat Simulation Outputs or AI Outputs as substitutes for professional advice or due diligence
  • Verify any critical data points or recommendations independently before acting on them

8.5 No Guarantee of Results

Simulation results represent probabilistic scenarios based on the data you provide, not guarantees of future performance. To the extent that any simulation incorporates historical patterns or statistical distributions, past performance is not indicative of future results. While the engine is designed to provide meaningful, data-driven scenario analysis for business planning, actual outcomes may differ from simulated results due to factors beyond the scope of any model.

9. Intellectual Property

9.1 Our Intellectual Property

The GrowthSim platform, including its simulation engine, AI models, algorithms, statistical methods, user interface, documentation, branding, and all related intellectual property, is and remains the exclusive property of Growthsim OÜ and its licensors. • Use of your identifiable data for AI model training requires separate, explicit opt-in consent. See our Privacy Policy, Section 4 for details

9.4 License to GrowthSim

You grant us a limited, non-exclusive, worldwide license to use, process, store, and display Your Data solely as necessary to provide the Service to you and your Organization. This license terminates when you delete Your Data or your account, except for data that has been irreversibly anonymized and incorporated into aggregate datasets as described in Section 9.3.

9.5 Feedback

If you provide feedback, suggestions, ideas, or recommendations regarding the Service (“Feedback”), you grant GrowthSim an irrevocable, non-exclusive, royalty-free, worldwide license to use, modify, and incorporate such Feedback into the Service without restriction or obligation to you. Feedback is provided voluntarily, and you have no expectation of compensation or attribution.

10. Data & Privacy

GrowthSim collects and processes business data necessary to run simulations, provide AI-powered analysis, manage your account, and process payments. We classify all data into five tiers, each with different rules for access, retention, encryption, and AI training eligibility.
